An ICC Arbitral Tribunal has issued a major quantum award totaling approximately EUR 112 million to AOP Orphan Pharmaceuticals GmbH (AOP Health). The ruling resolves long-standing damages claims against PharmaEssentia Corp. regarding their licensing contract for BESREMi (ropeginterferon alfa-2b). Specifically, the ICC Arbitral Tribunal determined that PharmaEssentia owes EUR 82 million for intentional contract breaches. Furthermore, the tribunal awarded EUR 31 million plus interest to reimburse AOP Health for product overcharges between 2019 and 2022. Crucially, judges confirmed that PharmaEssentia overcharged AOP Health by up to 900 percent during those years.
In addition, the ICC Arbitral Tribunal affirmed AOP Health’s right to offset EUR 17 million in profit-sharing payments. Consequently, AOP Health owes zero payment to PharmaEssentia going forward. Interest will continue accruing on AOP Health’s awarded claims until PharmaEssentia fulfills its legal financial obligations. Despite legal battles, AOP Health continues securing stable access to BESREMi for rare blood cancer patients. Now in its seventh year since European Medicines Agency approval, the therapy reaches roughly 12,600 patients across licensed territories.

The Higher Regional Court of Frankfurt had previously confirmed the underlying merit award in April 2026.

The commercial dispute dates back to 2009, when AOP Health bought the development and distribution rights for BESREMi. The coverage territory covers the European, Commonwealth of Independent States and Middle Eastern healthcare markets. The trouble began in 2017 when PharmaEssentia tried to unilaterally terminate the licensing contract. But an ICC Arbitral Tribunal threw out those termination efforts in October 2020.
